What form of salary certificate is valid in 2020

Many people mistakenly believe that this certificate is in the form of 2-NDFL. However, this is not quite true. Of course, there is data on wages here. Typically, this form is required by financial organizations when a citizen wishes to receive a loan. However, if the organization does not have an approved form, this document is allowed to be drawn up in free form.

The law allows the employee to request this certificate. He is not obliged to ask for it, but must receive it upon request. The data specified in the certificate is protected by law. Naturally, the entry must correspond to the information in the certificate.

What is the difference between a salary certificate and a 2-NDFL certificate?

Some people believe that the average salary certificate and the 2-NDFL certificate are the same thing. But that's not true. You need to understand their differences from each other.

A certificate of average monthly salary contains data on the amount of income for a certain period, the person’s position and place of work. This document is drawn up in free form depending on the situation. But in any case, it should display the following information:

  3. Date of issue and certificate number.

  5. Signatures of persons responsible for this issue.
  6. Seal of the organization.
  7. Monthly salary data and total income.

Certificate 2-NDFL is a strictly unified document. The form of this certificate was developed and approved by the Federal Tax Service of the Russian Federation. It provides complete information not only about the employee’s income, but also about the taxes he paid for the required period of time. Certificate 2-NDFL must contain information such as:

  1. Full name, date of birth and passport details of the employee.
  2. Taxpayer identification number of the person to whom the certificate is issued.
  3. Complete tax information.
  4. Calculated and paid personal income tax.

The form of the salary certificate is certified by the seal of the organization and the signature of the chief accountant. All information displayed in the issued document is duplicated in the database of the Federal Tax Service Inspectorate at the place of residence. Therefore, the reliability of the information is beyond doubt. It is popular as a universal salary certificate. When do you need a certificate of average earnings?

Naturally, a certificate is required for a bank loan. However, other organizations may also require it:

  1. For the embassy . If a citizen is going to obtain a visa to enter another country, he needs to confirm his financial reliability. In addition, representatives of a foreign state must be sure that you are going to return home. Among other things, this is confirmed by the presence of a stable income and permanent work in the homeland. Naturally, the person who has a large income is more likely to receive a visa. The key to obtaining a visa is to provide a certificate of income in the established form. Countries included in the Schengen area adhere to general rules. However, different embassies may have different requirements.
  2. For maternity leave . It is worth noting that while on maternity leave, a woman has the same rights as other employees. Therefore, at any time he may require a certificate of income. Maternity leave must be paid, but the amount of payments directly depends on wages. This takes into account the average daily earnings, the billing period, and the duration of maternity leave. A young mother should receive 40 percent of the average salary.
  3. For the employment center (labor exchange) . Regardless of the reasons for which a person is left without work, he can register at the labor exchange, receiving the status of an unemployed citizen. At the same time, he has the right to receive benefits. However, the amount of this benefit depends on the salary that was accrued to him at his previous job. As a rule, there is enough information here for the last three months of work.
  4. For social security subsidies . In a social state, which is the Russian Federation, every citizen, finding himself in a difficult situation, can hope for support. The social service can assign benefits, allowances, and compensation for housing and communal services. As a rule, this is possible if the cost of living is higher than his income.   5. For the court . During legal proceedings, the court may require a document confirming the income of the participants in the process. Most often this is associated with proceedings regarding alimony payments, division of property, preservation or deprivation of parental rights. In what cases is a document usually required?

The most popular is the salary certificate in form 182n, which is used to calculate various benefits from the Social Insurance Fund (sick leave, maternity leave, child care benefits). Before the approval of Form 182n by Order of the Ministry of Labor dated April 30, 2013, certificate 4n was used for the listed purposes. Now certificate 182n is used; We’ll show you what the document is for with examples.

  1. The employee needs to calculate the benefit, and for two calendar years, which are included in its calculation, he worked for another employer. In this case, the specified document with the amount of average earnings can be obtained from the former employer upon the personal application of the former employee no later than three working days from the date of filing the corresponding written application or upon the application of his legal representative (by power of attorney) or it is sent by mail (clause 4 of the Procedure issuing a certificate of salary amount);
  2. The employee quits. In this case, in accordance with clause 3, part 2, art. 4.1 of the Federal Law of December 29, 2006 No. 255-FZ “On compulsory social insurance in case of temporary disability and in connection with maternity”, a certificate of average earnings is filled out and issued to the employee on the day of dismissal.

If it is impossible to deliver a document on the amount of average earnings directly on the day of dismissal, the employer must send the former employee at his place of residence a notice of the need to appear for it or to give consent to send it by mail. If he agrees to sending by mail, the former employee notifies the employer in writing (clause 2 of the Procedure for issuing a certificate of salary amount). Regardless of what form the certificate has, the following mandatory information must be present:

  • name of the organization that issued the document and its details;
  • passport details;
  • average monthly salary;
  • the amount of accruals and funds actually received;
  • date of issue of the document;
  • the locality in which the organization is located;
  • confirmation that the person is an employee of this company;
  • job title.

In addition, here you can indicate the amount of deductions of insurance premiums and taxes. If you need a “net” salary, this information can be omitted. If the organization has some kind of debt to an employee, it would also be useful to indicate it.

Information about income can be specified in a list. However, it is more convenient to read by drawing up a table. Here the amounts received can be listed monthly. After the table, the validity period of the employment contract concluded with the employee is indicated. Even if an open-ended contract was concluded, this must be indicated in the certificate.

Responsible persons must sign the document. These are the director of the company and its chief accountant. By putting their signatures here, they confirm that the information provided is correct. Naturally, all information must correspond to reality. Supervisory authorities can freely check the data. If they are indicated incorrectly, the responsible persons, namely the director of the company and the chief accountant, will be fined a fairly large amount.

Document for the employment service

Unemployed are considered able-bodied citizens who:

  • have no job or income;
  • registered with the employment service in order to find suitable work;
  • looking for a job and ready to start it.

To provide information on average earnings, the form recommended in Letter of the Ministry of Labor dated August 15, 2016 No. 16-5/B-421 is usually used.

In addition, the form of information on average earnings can be approved by regional authorities. For example, this is what they did in the Moscow region.

You can find out whether a constituent entity of the Russian Federation has an approved form at the regional Department (Committee) for Labor and Employment. But most often (and the Ministry of Labor considers this completely acceptable) a salary certificate is drawn up in free form, a sample of which can be seen below.

A document on the amount of average earnings for the employment fund can be drawn up by the employer in any form, but must contain information necessary to determine the amount and timing of payment of unemployment benefits (details generally accepted for the papers of the organization (employer) and information on average earnings calculated in accordance with with the legislation of the Russian Federation).

Also, confirmation of information about income received is a document in form 2-NDFL, which is issued by the employer at the request of the employee.

A document about the amount of average earnings may be required at the embassy for a visa or at a bank for issuing loans. There are no statutory forms for presenting information on average earnings.

The main thing for certificates in free form is that they contain reliable information about the employer and employee, as well as the real amount of the employee’s income, signatures of persons authorized to sign, and a seal (if any).

Rules for issuing a salary certificate from your place of work

As a rule, a salary certificate is written on an A4 sheet. An organization can also develop its own letterhead. By law, the certificate can be filled out not only by hand. A document submitted in printed form is also valid.

The certificate may have several copies. The employee must indicate their number in his application. In this case, the employee may not report for what specific purposes he needs a certain number of certificates. A prerequisite for the correct execution of the document is the presence of signatures of the manager and the chief accountant. The organization stamp must also be present here. The only exception is the situation when the certificate is issued by companies or individual entrepreneurs who have the right to work without using stamps.

Bodies to which a salary certificate can be submitted

There are many different organizations that may require proof of your financial independence or, conversely, proof of too little income. In addition to the organizations listed above, this document may be required by other bodies:

  • guardianship authorities, when deciding which parent the child should live with;
  • Pension Fund. The certificate submitted along with other documents is the basis for calculating pensions;
  • tax office.

Where can I get help?

To obtain a certificate, the employee will need to contact the employer with a request (application) to provide information about wages.

The certificate will be provided to the employee within 3 working days from the date of writing the application. Refusal to issue a certificate is grounds for appealing to the labor inspectorate or court.

In addition, you can obtain help:

  • to the Federal Tax Service, if the employee has changed several jobs and then cannot find one or more organizations, by submitting an application in person;
  • via the Internet, in the taxpayer’s personal account;
  • through the Pension Fund, if the Federal Tax Service does not have data. In this case, the application is also drawn up in the name of the employer, and he already requests information from the Pension Fund himself.

An already dismissed employee can also receive a certificate, provided that no more than three years have passed since his dismissal.
