What is a pilot project

A pilot project is an experiment in which the Russian Social Insurance Fund directly pays social benefits without the participation of employers. Also, as part of the pilot project, the foundation, at its own expense, finances expenses for the prevention of injuries and occupational diseases. Contributions for “injuries” are not included in the financing.

For 2021, the experiment of the social insurance fund is being tested on itself (see table).

FSS pilot project 2021: list of regions

Other payments (funeral benefits, payment of additional days off to employees with a disabled child, additional payments for children financed from the federal budget) continue to be made by the employer, and the fund then (after providing the necessary set of documents) reimburses the policyholder for the money spent. them amounts. Funds spent by the insured to prevent industrial injuries and occupational diseases are also subject to reimbursement.

Timeframes relevant for payments under the pilot project

  • 5 days according to the calendar are given to the employer to send the employee’s application and documents (information) necessary to calculate the payment amount to the fund;
  • 2 weeks in advance, the insured is required to submit to the fund an application from the employee for payment of leave provided to continue treatment, and an order issued by the employer for such leave with the calculation of vacation pay;
  • 5 working days are given to the fund to send a notice to the policyholder about information that turns out to be missing, and to the employer to respond to this notice;
  • within 5 working days from the date of receipt of the leave payment fund, he makes a decision regarding this payment;
  • 10 days according to the calendar are allotted to the fund to make a decision on the assignment of benefits and its payment (during the same period the fund needs to make the payment itself if the sick leave was issued in connection with an accident at work or an occupational disease);
  • within 2 working days, the one-time amount paid (including the first payment of child care benefits and vacation pay) is transferred to the bank account specified by the employee in the application;
  • the days corresponding to the 1st-15th of the month following the month of accrual are linked to child care benefit payments made monthly after the first payment;
  • 3 working days are given to the policyholder to notify the fund of the circumstances serving as grounds for termination of payment of child care benefits, and to the fund to accrue benefits for corrected sick leave, the need for adjustment of which was identified when checking the set of documents.

How sick leave is assigned as part of a pilot project

In order for an employee to receive the sick leave benefits due to him as part of the pilot project, he still submits all the necessary documents to his employer. If the employee’s disability is not related to an industrial accident, he submits to the employer:

  • application for payment of benefits in the form approved by order of the Federal Social Insurance Fund of Russia dated September 17, 2012 No. 335;
  • certificate of incapacity for work;
  • certificates of earnings from previous places of work for the pay period, if they have not been submitted previously.

The employer must submit the received documents within five calendar days to the branch of the Federal Social Insurance Fund of Russia at the place of his registration. Attached to them is an inventory of the documents being transferred in accordance with the form from the order of the Federal Social Insurance Fund of Russia dated September 17, 2012 No. 335.

The FSS branch of Russia reviews the documents within 10 calendar days and makes a decision on payment of benefits or refusal. If the decision has a “plus” sign, then the money is sent to the employee’s bank account using the details that he noted in his application.

It is worth keeping in mind that the Social Insurance Fund pays disability benefits in the usual manner. That is, starting from the fourth day of sick leave, benefits are paid to the employee for the period of his temporary illness not by the employer, but directly by the Social Insurance Fund. In this case, the employer must pay the subordinate for the first three days at his own expense.

FSS pilot project - Direct payments

The application form for payment of benefits is established by Order of the Federal Social Insurance Fund of the Russian Federation dated November 24, 2021 N 578. This application must be filled out by the employee, but as a rule, the employer does this independently to reduce the number of errors. The employee only has to check whether the bank details are correct and sign.

Which regions are participating?

Employees receive protection: they are spared from delayed payment of benefits or complete non-payment, as well as from controversial situations with the employer. However, the employer must now be more responsible about the deadlines for submitting the package of documents, as well as the correctness of filling out sick leave.

Reporting on insurance premiums is also simplified for him, since in the quarterly report he generates, he no longer needs to fill in information about the payments that the fund now makes, and there is no need to submit to the Social Insurance Fund a set of documents for reimbursement of funds spent by the policyholder on social payments in excess of the amount accrued for payment of contributions.

How to fill out sick leave for a pilot project

The organization whose employee received sick leave fills out only the continuation of the form - its second part. Registration of the first is the responsibility of the specialist of the medical institution that issued the document.

So, first, the form contains information about the company - its name. Then they note whether this is the person’s main place of work or whether he is employed here part-time. Below on the form of the certificate of incapacity for work indicate the tax registration number and subordination code. After this comes information about the employee such as TIN and SNILS.

Next, you will need to indicate the person’s work experience. Below are the start and end dates of the employee’s period of disability. To calculate the amount of benefits, his average and daily earnings are also indicated.

After this, the amounts that should be accrued to the sick person by his employer and the Social Insurance Fund are given. Below they are summed up and the total amount of benefits that will be paid to the person for the period of his illness is displayed.

Be sure to indicate the surnames and initials of the head of the company, as well as the accountant or HR employee who filled out the sick leave. These persons put their signatures in the lower right corner.

Filling out sick leave from the minimum wage: sample

Filling out sick leave according to the minimum wage in 2021 will take into account the new value of the minimum wage. The minimum wage law 2021 has not yet been adopted, but the Ministry of Labor has already established a new living wage for the 2nd quarter of 2021 for able-bodied citizens - 12,130 rubles. This means that this will be the minimum wage from the beginning of 2021 (Order of the Ministry of Labor No. 561n dated 08/09/2021; Law dated 06/19/2000 No. 82-FZ), which is 850 rubles. more compared to the minimum wage in 2021 (RUB 11,280). Can they refuse and why?

After receiving the documents or register, the fund can request the missing papers from the company within 5 working days. The employer has 5 working days from the date of receipt of the notice to send documents or information (clause 7 of the Decree of the Government of the Russian Federation dated April 21, 2011 No. 294, as amended on December 1, 2021).

Nuances of entering data

As has already become clear from the above, the pilot project does not affect the filling out of sick leave by the employer . However, it will be useful for employees who are delegated to issue temporary disability certificates in the organization to refresh their memory of some of the nuances associated with this professional task.

Pen and ink

According to paragraph 65 of the Procedure, approved by order of the Ministry of Health and Social Development of Russia No. 624n, filling must be done exclusively with a gel, fountain or capillary pen. It is prohibited to use ballpoint pens for these purposes. Ink can only be black.

High tech

You are allowed to fill out the form using computer technology. At the same time, FSS letter No. 17-03-09/06-3841P states that partial filling out by hand if using a computer will not be an error.

Letters

Information about the organization and the employee is entered into the sick leave form exclusively in capital Russian letters. If the company name contains foreign elements, their combinations, as well as abbreviations, they should not be changed into Russian.

Cells

Filling should occur exclusively where the appropriate fields and cells are allocated for this. It is prohibited to go beyond their limits.

Seal

It is important to note that a seal is affixed to a sick leave certificate only if it is provided for in the company’s charter. There is a place on the right for her. You can go beyond its limits, but the print should not overlap part of the data in the cells.

How to fill out a paper sick leave for an employer: sample 2021

Paragraph 65 of the rules approved by Order No. 624n states that the use of corrective agents to cover up errors made when issuing a certificate of temporary incapacity for work for an employee is strictly prohibited. Instead, you need to turn the document over and write the correct information on the back.

Instructions for filling out sick leave for 2021: features

Its essence is that the amount of money due to the employee from the fourth day of his period of incapacity for work is paid by the Social Insurance Fund. The sample for filling out sick leave by the employer remains the same.

In general, the sick leave block filled out by the employer is signed by the manager and chief accountant. However, it is permissible to delegate the authority to sign sick leave to other persons. To do this, they need to issue a power of attorney, taking into account the provisions of Art. 185 of the Civil Code of the Russian Federation. At the same time, there should not be any marks on the sick leave form itself indicating that the document is signed by power of attorney.

  1. Information about the employee’s place of work by indicating:
      the name of the company (full or abbreviated) in accordance with the constituent documents, if the employer is a legal entity;
  2. Full name of the entrepreneur, if the employer is an individual entrepreneur.
  1. A note indicating whether the work is primary for the employee or not by checking the appropriate box.
  2. Employer registration number in the Social Insurance Fund.
  3. Code of subordination of the FSS body that issued the registration number to the employer.
  4. TIN of the employee for whom sick leave is issued (not indicated for women receiving maternity benefits for pregnancy and childbirth, as well as after registration with a medical institution in the early stages of pregnancy).
  5. SNILS of the employee.
  6. Code indicating the conditions for calculating sick leave (1 or more) - on the reverse side of the sheet:
      43, if the employee has benefits as a victim of radiation exposure;
  7. 44, if the employee until 2021 worked in the regions of the Far North or in territories equivalent to them;
  8. 45 if the employee has a disability;
  9. 46, if the term of the employee’s employment contract with the employer is less than 6 months (not recorded if the cause of disability is indicated on the sick leave as corresponding to code 11);
  10. 47, if the employee went on sick leave within 30 days after dismissal;
  11. 48, if going on sick leave was accompanied by a violation of the regime for a good reason (subject to marking this in the appropriate column of the form);
  12. 49, if the illness of an employee who has a disability at the time of going on sick leave lasts 4 consecutive months or more (not entered if code 11 is indicated in the column where the cause of disability is given);
  13. 50, if under the same conditions the sick leave lasts 5 or more months in a calendar year;
  14. 51 if the employee is employed part-time.
  15. Details of the report in form N-1 (about an accident during work), if it was drawn up.
  16. The start date of work of the employee whose contract was canceled, but he went on sick leave before the cancellation. If the employment contract with the employee is valid, the corresponding column does not need to be filled out.
  17. Length of insurance period in full years and months.

Where to download an example of filling out a new sick leave form for 2021

  • the amount of the employee’s earnings for each of the 2 years taken into account when calculating benefits;
  • the employee’s total earnings for the billing period (adjusted for the maximum base for calculating contributions to the Social Insurance Fund);
  • the employee's average daily earnings;
  • the amount of the employee's daily benefit;
  • the total amount of the employee’s calculated benefits, as well as personal income tax on it.

Some accountants are wondering: how to fill out a sick leave certificate (approved by Order of the Ministry of Health and Social Development of the Russian Federation dated April 26, 2021 N 347n) for a pilot project? In fact, the FSS pilot project has no effect on filling out sick leave. After all, the essence of the pilot project is that the payment of sick leave benefits, calculated from the 4th day of the employee’s illness, is made immediately by the Social Insurance Fund, and not by the employer, who then reimburses these amounts from the Fund. Consequently, the procedure for filling out sick leave by an employer who operates in a region participating in the FSS pilot project is the same as in a region not participating in this project.

Step-by-step instructions for filling out a sick leave certificate by an employer

In some cases, the calculation of sickness benefits may differ from generally accepted norms. Each exceptional situation has its own unique code. All types of special calculation conditions are listed on the back of the form (codes 43 to 51).

Step No. 2. Type of employment

Let us repeat that you can fill out the certificate of incapacity for work only with black paste, gel, fountain or capillary pen. But if you fill out a document with a simple ballpoint pen, then problems with controllers are likely.

  1. There should be no blots or corrections when filling out the sick leave form by the attending physician.
  2. If the sick leave is filled out manually, then only black ink is used, and each letter is in a separate cell. All letters are exclusively capital letters, that is, CAPITAL. Printed filling out of sick leave is also allowed.
  3. The doctor provides information about the patient’s place of work, and also indicates what kind of work it is – main or part-time. In the case of a part-time job, the patient has the right to request sick leave to be provided to each company - both the main one and part-time.
  4. The tabular part of the sick leave record contains information about the period of incapacity for work and the cause of incapacity for work. If a sick leave is opened due to a child’s illness or caring for a sick relative, then all this is also filled out by the doctor. The procedure for filling out is prescribed in clauses 56-63 of the Procedure for issuing certificates of incapacity for work.
  5. The signature of the attending physician and the seal of the medical organization.

Rules for filling out sick leave by an employer in accordance with the requirements of the Ministry of Social Development

The employer is allowed to make corrections when filling out its part of the l/n. This is done by simply crossing out and writing on the back of the form “Corrected Believe” with a signature and a round seal (if available).

How to fill out a sick leave certificate for an employer, continued

By law, an enterprise is not required to keep a log of sick leaves for its employees. Each manager decides independently whether he needs to systematize information about periods of employee incapacity for work.

Citizens working under an employment contract at an enterprise of any type in the event of illness have the right to receive compensation in the form of payments under a certificate of incapacity for work. Filling out a sick leave certificate includes two parts:

The sick leave certificate is certified by the personal signature of the doctor and the seal of the medical institution. In this form, it goes to the employer for further processing. The triangular seal of the hospital should appear at the top under the document number and in the table with the start and end dates of the sick leave.

What is the difference between paper and electronic sick leave?

  • one of them is drawn up by the doctor who treated the person throughout the disease;
  • the second part is filled out by the employer - manager, chief accountant, person responsible for maintaining personnel and financial records.

The pilot project is that the Fund directly, without the participation of employer companies, pays social benefits to insured persons.
