In what cases is it necessary to make changes to the registry documents?

So, let's take it in order. When information about your last name, place of registration, series and passport number changes, it is not necessary to inform your tax inspector about this. An exchange of updated data has been established between the tax authority and the Federal Migration Service. Therefore, in the Unified State Register of Individual Entrepreneurs, a new surname and place of residence appears automatically , without your petition (according to the norms of RF Law No. 129-FZ, Chapter II, Article 5, Clause 4).

Of course, when changing the type of business activity, it is necessary to make amendments to the register of individual entrepreneurs. To do this, it is not necessary to use the services of a lawyer who will draw up the documents for you, but will ask for Bank of Russia tickets in return. It is quite possible to update information for the tax office on your own, especially since it is not at all difficult.

When to visit the tax office

If you have registered an individual entrepreneur, then you need to know in what cases you will need to additionally contact the tax office. There may be several such cases during the operation of your business. They will be related to changes in legislation, reporting or the internal organization of your company. For example, if you decide to change the direction of your activity, then a trip to the tax authority cannot be avoided.

The special register of individual entrepreneurs of the Unified State Register of Entrepreneurs contains up-to-date information about each individual entrepreneur in the country. In order for this information to be updated on time, you need to report any changes to the tax office. This is important not only for government agencies, but also for contractors who may be interested in your activities.

You will need to report to the tax office if there have been changes related to:

  • Full name (if you got married or just changed your last name, first name);
  • Registration address;
  • Place of residence;
  • Citizenship;
  • Changing your passport (if the document is lost or has expired. When changing your last name or first name, you also need to change your passport);
  • OKVED codes (if you want to change the main or additional codes).

However, changes do not need to be reported to the pension fund or health insurance fund. The tax authority will do this for you. If you have acquired a license for some type of activity, then this must be recorded in the Unified State Register of Entrepreneurs. However, this is also not what you do. Changes are made by the organization that issued your work permit.

Documents for individual entrepreneurs

In order for new data to appear in the register, you will need to contact the tax office at the individual entrepreneur’s registration address with the following documents:

  • Original and photocopy of your passport (and if the documents are submitted by a representative, then also his passport);
  • TIN form;
  • Certificate of registration of individual entrepreneur (OGRNIP);
  • A document that confirms the changes (for example, a certificate of marriage or change of surname);
  • Application in form P24001 for registration of changes.

You have the right to submit documents in the following ways:

  • By contacting the tax office;
  • Through an assistant, for whom you first issue a notarized power of attorney;
  • By letter by mail;
  • By visiting the tax service website;
  • By going to the multifunctional center (you can do it yourself, through a representative, or submit an application through the website).

If you are going to visit the tax authority yourself, you can make an appointment with an operator in advance online. To do this, go to the official tax website, select your region, the inspection office where the individual entrepreneur is registered, and the date and time of the future visit. In this case, you do not have to wait in line: a specialist will see you according to the time specified in the electronic ticket.

When preparing documents through a representative, do not forget to make a power of attorney. It must only be notarial. The tax office does not accept other types.

If you send documents by mail, be sure to have each sheet certified by a notary. Make an inventory of all enclosed papers and send a registered letter.

To make changes to the Unified State Register of Individual Entrepreneurs through the tax service website, you must have access to your personal account. The login and password for it can be registered upon a preliminary personal visit to the tax authority. To send documents online, you will need an electronic signature. It also needs to be agreed upon with the tax service.

By contacting the multifunctional center in any way, you, just like at the tax office, will be able to register the change in data in the Unified State Register of Individual Entrepreneurs. He acts as a kind of intermediary between any entrepreneur (and even individuals who are not registered as such) and government agencies.

We enter new data into the Unified State Register of Individual Entrepreneurs

The procedure for entering new data is not complicated.

It consists of several stages:

  • We collect all the required documents and go to the tax office;
  • We fill out an application for making changes, sample P24001 (you can first download it from the tax website and print it or fill out the form provided by the operator);
  • We hand over the package of papers to the tax specialist;
  • After some time, we receive notification of the completed certificate of changes and pick it up.

Previously, the tax office issued an extract from the register along with a certificate confirming the registration of changes in the Unified State Register of Individual Entrepreneurs. Today, the government body does not have such responsibilities. This means that for your own peace of mind, you can separately order an extract from the Unified State Register of Individual Entrepreneurs. You can get it at the tax office or leave a request through the inspection website. In both cases, the document will be free for you.

We meet deadlines

The legislator has established certain deadlines for entrepreneurs to notify about their own changes. If this is not done on time, then you can say goodbye to some amount in favor of a fine.

Within three days you are required to report new data to the tax authority. This needs to be done as quickly as possible and not put off going to the tax office. Once you have received your marriage certificate or new passport, do not hesitate to avoid unpleasant consequences.

Your documents are registered by the tax authority within 5 working days. During this period, she will enter new data into the Unified State Register of Individual Entrepreneurs (USRIP). After updating the information in the register, the tax office has one business day to notify you of the entered data. If this deadline is not met, you have the right to appeal the actions of the tax authority within three months.

If you do not meet the three days required by law, you will pay a fixed fine of 5,000 rubles. If you hide some data from the tax office and deliberately do not enter it into the register, you will say goodbye to 10,000 rubles.

To ensure that your activities do not bring unplanned expenses, follow legislative measures and be sure to notify the tax authority.

Price issue

No matter how many changes you make to the state register, you will not be charged a penny: there is no state duty for entering data. Any changes are absolutely free for you. An individual entrepreneur pays only for registering activities and closing his business.

However, in some cases you will still have to pay some amounts:

  • If a representative will submit documents for you, a notarized power of attorney is required. Its registration costs from 1000 rubles;
  • To certify documents at a notary office, you need to pay at least 1000 rubles;
  • If you often send papers to the tax office through your personal account, then it makes sense to issue an electronic signature. It will cost you 1,500 rubles and more;
  • To certify documents for an electronic signature, an amount of at least 3,000 rubles will be required;
  • If, to resolve the issue, you decide to contact an intermediary company that, for a fee, submits documents to help individual entrepreneurs, then its services will cost at least 2,500 rubles.

In order to make changes to the information concerning an individual entrepreneur in the Unified State Register of Entrepreneurs in 2021, you need to prepare an application in form P24001 and other necessary documents, sign the application correctly and choose a convenient way to submit documents to the tax office. There is no need to pay a state fee for making changes.

In most cases, if any individual entrepreneur data changes (registration, last name, etc.), the migration service automatically notifies the Federal Tax Service through interdepartmental channels. However, there are cases when the entrepreneur himself is obliged to inform about changes:

  • The data has not changed, it’s just that there are previously reported errors in the information in the Unified State Register of Individual Entrepreneurs;
  • The individual entrepreneur is not a citizen of Russia;
  • It is necessary to add or delete the OKVED code or change the main code;
  • For some reason, the FMS did not initiate the change of data and you need to do it yourself.

If you are required to independently inform the inspectorate about changes, this must be done within three working days. For failure to comply with this deadline, you may face a fine of 5,000 rubles.

To submit documents to the inspectorate to make adjustments to the Unified State Register of Individual Entrepreneurs, proceed in the following order.

Nuances of entering code data

When filling in the numbers in the cells of the main activity code, keep in mind that there is only one. There are some nuances when filling out additional codes:

  • the tax office will not accept a double-sided printed application from you - this is prohibited by law;
  • if you only need one sheet of the form to fill out, you don’t have to print and number the blank pages of sheet E;
  • record line by line from left to right;
  • When adding codes in the cells of additional activities, do not enter existing ones.

So, to add new codes:

  1. We select the necessary digital codes with encoded information about the types of your activities according to OKVED.
  2. We enter them in the appropriate block of the application (sheet E page 1).

To exclude codes that have expired, in your case:

  1. We select individual entrepreneur activity codes from the Unified State Register of Individual Entrepreneurs (USRIP) extract.
  2. We enter them in the corresponding block on page 2 of sheet E.

If there is a need to leave the previous activity code, then enter it as additional on Art. 1 sheet E. in cells intended for additional codes.

Important point! From July 11, 2021, updated codes for state registration of legal entities and individual entrepreneurs were introduced.

Applying in person

When submitting documents in person to register new types of economic activity, you must present a passport. In this case, there is no need to certify the application with the help of a notary (according to Federal Law No. 129-FZ, Chapter III, Article 9, Clause 1.2). On sheet G of the form, in the presence of a tax officer, you need to manually fill in your full name and sign.

Important! You will not need to re-pay the state fee for changing individual entrepreneur data in the state register. If your inspector forgot about this, you should always remember this so as not to overpay extra money.

We send application P24001 by mail

There are often situations when a businessman cannot personally appear to the inspector to enter new data into the register: long business trips, vacations and other important reasons.

Remote sending is possible. In this case, it is necessary to perform notarized confirmation of the signature on the application.

No problem! The completed form can be sent by mail. Although to do this you will still have to visit a notary office. Agree that it is better to pay this specialist for services than, for example, to change a ticket for an expensive airline flight abroad. The notary will sign and seal Form P24001, certifying the authenticity of the copy of your passport.
