Application for time off at your own expense

It should be noted that in labor legislation such terms as time off and day off at one’s own expense are absent. They are replaced by the concept of leave without pay. But the above concepts are used in everyday life and they are also written in the application.

There are two types of time off:

  • Time off that a person can receive without the consent of the employer at a time convenient to him for working on a holiday or day off.
  • Time off that requires management consent.

The Labor Code also allows employees to take vacations at their own expense upon the occurrence of certain cases: marriage registration, death of a family member, etc. He also determines how many days you can take at your own expense in these cases. The minimum duration is five days, but the employer in its local regulations can provide for a longer duration. The employee is not required to take these vacations, and if he is forced to write an application at his own expense, it will be illegal.

Who is entitled to additional days of rest?

The legislation determines the possibility of employees receiving time off, regardless of the amount and duration, subject to agreement with the employer. This means that the parties have the right to agree on any unpaid leave and issue it if there are no objections.

However, there are categories of employees and cases when the management of an enterprise cannot legally refuse to provide time off in the amount established by the Labor Code of the Russian Federation.

In accordance with the meaning of Article 128 of the Labor Code of the Russian Federation, these include:

  • WWII veterans (up to 35 days a year);
  • pensioners who continued to perform labor functions (up to 14 days);
  • disabled people – maximum 60 days;
  • wives (husbands) and parents of military personnel who passed away while on duty - up to 14 days a year;
  • donors - in direct proportion to the number of times they donate blood and its components;
  • Any employees can count on 5 days of compensatory leave in the event of: joining a family union, death of a close relative, birth of a child.

In the listed situations, providing additional days of rest in a certain amount is the responsibility of the employer; in other situations, the employee’s departure is permitted only with the agreement of management.

How to write an application at your own expense

In order to receive a day at your own expense, you must submit an application. This rule should not be neglected even if the employee and the employer agree among themselves that time off will not be issued by order. A written statement will protect both the employee (if the employer decides to count him absenteeism) and the employer (if an accident occurs with the employee at this time).

Application at your own expense for 1 day

Most often, time off is taken for one full day, or for several full days, in which case the employee does not go to the workplace for the entire work shift. The corresponding o or “OZ”) is entered in the working time sheet, 0 is entered in the “hours” column, or it remains empty.

Application for half a day at your own expense

But the law does not prohibit an employee from writing a statement for part of the working day, for example, half. In this case, the report card will indicate attendance at the workplace (code “I”), but the number of hours will reflect the actual stay at the workplace.

Examples of statements under different circumstances

When writing requests for time off for special circumstances, you should consider the wording. For example, how to write a leave of absence for several hours if you need to take your child to the clinic? Please indicate specific circumstances. For example, write: “Please allow me four hours from 08:00 to visit a pediatrician (full name) at a medical institution (indicate the clinic number).

The need to place a relative in the hospital, bring things, or leave to give testimony or examination is the basis for which time off is required. Depending on the complexity of the situation, documents are attached when re-writing the application.

For example, a child has an accident, the mother urgently leaves work. The management accommodated and released the employee for a few hours. The next day, the woman asks for three days off without pay to visit the child. At the same time, she provides an extract from the hospital where the child is actually staying and writes the following statement: “I ask that you allow me to leave my workplace on April 28 for three hours from 11:00 to 14:00 in connection with a visit to the medical institution where treatment is taking place.” my young child (full name).”

Provided that time off can be taken in advance, for example to repair the heating system, it should indicate strong and convincing reasons. However, this will not be included in the vacation bill, since it is not a reason or a necessary measure, and unplanned vacation is most often not included in the total number of paid days. Of course, relations with management should also be taken into account - many do not cooperate on principle, not wanting to put themselves in the position of an employee.

Below is an example of how to write an application for time off for a few hours:

“I ask you to provide me with an additional day of rest on June 13, 2013 for work on a holiday on May 1, 2013, which was not paid at a double rate, and therefore I believe that I am entitled to time off.”

Application form at your own expense

The application form is free at your own expense and is not regulated in any way by law. But at the same time, it must contain the mandatory details of all applications:

  • Full name and position of the manager;
  • Full name and position of the employee;
  • Date and signature of the author of the application.

The text of the application itself will depend on the basis on which the leave is taken and what its duration is.

Application for a day off at your own expense

Despite the fact that the text is written in free form, in practice, office work has developed certain formulations that the statement should contain:

  • Please provide a day at your own expense;
  • Please allow me to take time off at my own expense.

In the case when a day off is needed, simply indicate the desired date or dates.

Application for half a day at your own expense: sample

In the case when he wants to take only part of the day, he must indicate in the application the time period for which he will be absent:

  • Please give me time off from 13:00 to 18:00;
  • Please give me time off for the first half of the working day, etc.

You can also ask in your application for one full day and half of the other:

I ask you to provide leave at your own expense on 01/23/2018 and from 9.00 to 12.00 on 01.24.2018. The employee must sign and date the application.

Time off is given to a person on the basis of a written application, which can be drawn up in free form. An application for a day at your own expense must have an executive visa. As a rule, an order must be drawn up based on the application. But in some cases, as a result of an agreement between the employee and the employer, the order is not drawn up; accordingly, this is also not reflected in the report card, although this will be at odds with what labor legislation says.

Minimum short-term leave

They also give you a vacation at your own expense, which means at least a week.

The Labor Code of the Russian Federation has the concept of time off, which is described in Article 153. It specifies cases when an employee can take leave, as well as the conditions for receiving it. You must fill out the required form provided by the HR employee. The registration rules can be found in the sample application for time off for a few hours.

The law also provides for an indication of the reasons and incentives for taking unreasonable (unplanned) leave.

Weekends towards vacation

When you don’t want to lose money, but you need to take a weekend, you can use a convenient wording: “I ask you to provide two calendar days for paid leave from 10/05/2018 to 10/06/2018.”

At the same time, the employer will not be able to refuse you, even if the following days are weekends. However, here too a formality must be observed:

  1. The balance of all unused leave must be at least 14 days excluding holidays, minus the two days requested.
  2. You need to fill out an application three to four days in advance so that personnel officers can issue an order.

If you don’t know how to write an application for time off for a few hours, ask a company employee responsible for calculating working hours or preparing time sheets for a sample.

In addition, many employees take several hours of compensatory time off on working days of the week for the days they work. This is strictly stated in Art. 113 Labor Code of the Russian Federation. If they were not paid, but recorded, for example, in the log of the time employees arrived and left the workplace, the employee must be compensated for overtime in the form of additional pay or a day off.

In this case, you must refer to the individual agreement. It may stipulate special employment, implying not a 40-hour week, but also an appropriate salary. Remember that working on a day off is prohibited, so the employer is obliged to provide people with days off. According to Article 153 of the Labor Code of the Russian Federation, an employee has the right to receive double pay for work on a day off, or time off with payment at a single tariff rate. It turns out that there will be payment in any case, but time off is not always given, compensating for work at a double rate.

Important! If a company has an official holiday scheduled for March 8 or February 23, as is usually the case, but employees are told to work the day on Saturday, the work is paid at a single rate. Time off on holidays is provided by government regulation and all benefits are retained. But according to Article 152 of the Labor Code of the Russian Federation, a person can choose whether to receive monetary compensation for overtime (not to be confused with previously worked time) or to go on a day off not as planned. At the same time, it should be exactly as many hours as he worked per day. The total amount is calculated over the course of a week.

That is, the personnel officer must check whether the employee has previously used this part of the annual leave and whether he still has rest days left. Only in this case will it be possible to accept this application from the employee. How to competently ask for time off from work (sample application, reasons)

How to take time off from work if the reason for this is not included in the list of a priori recognized as valid? In this case, the result largely depends on the relationship with the employer and the nature of the work itself (for example, in continuous production this can be extremely difficult).

The safest reason from the point of view of labor legislation is donation. Donating blood is an absolutely legal and, at the same time, noble way to get two legal days off: directly on the date of blood collection (or its components) and on the next day. In addition, this time must also be paid.
