From January 1, 2021, the new federal minimum wage in Russia is 12,130 rubles. The federal minimum wage (minimum wage) is established simultaneously throughout the entire territory of the Russian Federation. Minimum wage 2021: law
The minimum wage in 2021 depends on the cost of living for the working population in the second quarter of 2021. The Ministry of Labor approved the living wage per capita for the second quarter of 2021. The cost of living is:

Minimum wage and regional coefficient in 2021
Before the adoption of the new law, some injustice was seen in the calculation of benefits: when comparing the actual amount of average earnings with the minimum wage, the regional coefficient (RC) was not taken into account. Although, when accruing, the final benefit amount was adjusted by an increasing factor. As a result, employees whose earnings were higher than the minimum wage, but lower than the minimum wage taking into account the Republic of Kazakhstan, received a smaller amount than those who were immediately assigned benefits at the “minimum wage”.
As of June 19, 2020, this imbalance has been eliminated. When calculating benefits after this date, the employer immediately adds regional coefficients and allowances to the minimum wage.
Which minimum wage should we focus on: federal or regional?
In a subject of the Russian Federation, in accordance with the agreement of such a subject, a regional minimum wage may be introduced (Article 133.1 of the Labor Code of the Russian Federation). It applies to employees in the relevant region, except for those who work in organizations financed from the federal budget and those whose employers have followed a special procedure for refusing to join the regional minimum wage.
The minimum wage established in the region of the Russian Federation cannot be less than the federal minimum wage. That is, in no region of Russia from January 1, 2021, the minimum wage can be less than 12,130 rubles.

However, it is worth saying that in cases where the regional minimum wage in a constituent entity of the Russian Federation is not approved, the minimum wage established by federal legislation is applied.
When to apply it is necessary to apply the federal minimum wage (RUB 12,130)
Employers must use the federal minimum wage when calculating wages, vacation pay, travel allowances and other payments that are calculated from average earnings. The minimum wage also affects three benefits: sick leave, maternity leave, and child care benefits up to 1.5 years.
When to apply regional minimum wages
In 2021, employers are required to apply regional minimum wages if they have joined the regional agreement.
Let us remind you that employers who, within 30 calendar days after publication of the agreement, have not sent a written reasoned refusal to accede to the document to the labor authority of a constituent entity of the Russian Federation will automatically join the regional agreement. If the employer sent such a refusal, then you can rely on the federal minimum wage. If the refusal is not sent, then the employer is obliged to comply with the provisions of the regional agreement.
How to draw up an order for additional payment to the minimum wage in 2021 (sample)
There are no special rules for registration or a unified form for such an order. Its form and content are determined by the employer.

Experts from the Onlineinspektsiya.rf service recommend stipulating additional payment up to the minimum wage in the employment contract. It is also possible to include this condition in salary and other regulations in force in the company (regulations on remuneration, collective agreement) with a corresponding reference to these documents in the text of the employment contract.
For paying wages below the minimum wage when the labor standard has been worked out, the employer faces administrative fines (Parts 6, 7, Article 5.27 of the Code of Administrative Offenses of the Russian Federation), and in special cases - even criminal punishment under Part 1 of Art. 145.1 of the Criminal Code of the Russian Federation.

Is the northern surcharge taken into account?
For workers in the Far North and equivalent areas, both regional coefficients and northern bonuses are used when calculating wages. But when calculating minimum wage benefits, both the regional and northern coefficients are not used simultaneously. The law states that the rule applies specifically to the regional coefficient. Therefore, when paying benefits at the “minimum wage”, only the Republic of Kazakhstan should be taken into account. Northern allowances are taken into account when calculating payments based on actual earnings as part of the amounts taken into account in the billing period for the previous 2 years.
If income is below the monthly minimum
When the average per capita family income does not exceed the monthly subsistence minimum per capita in the Vologda region, the family is recognized as low-income.
This status becomes the basis for residents of the region:
- for registration for the purpose of obtaining housing on social rental terms;
- to pay monthly child benefit;
- to assign benefits to the poor;
- to compensate for travel of pregnant women sent for examination and treatment;
- to compensate 50% of the travel of children in need of sanatorium treatment;
- for a one-time payment to purchase school supplies and uniforms for first-graders.
The specified payments, benefits and compensations are provided for:
- Regional Law of March 16, 2015 No. 3602-OZ “On the protection of family, motherhood, paternity and childhood...”.
- Resolution of the regional government dated February 29, 2016 No. 183 “On approval of the Procedure for providing social support measures to orphans, children without parental care, persons from among orphans and children without parental care, for payment of housing and heating.”

Payment for work consists of salary, compensation and additional payments. The minimum wage implies the unified minimum amount of money that an employer must pay its employee.
The minimum wage also affects the calculation of the amount of taxes, fines and other payments - those that are calculated according to the legislation of the Russian Federation depending on the established minimum wage. It also affects the size of some social benefits: unemployment, sick leave, pensions, etc.
Status and significance of the regional subsistence minimum
How the regional PM is formed and introduced is established by Federal Law FZ-134 of October 24, 1997. The authorities of the constituent entities of the Russian Federation determine only the values of indicators based on local data on the cost of products and services in the region. To do this, first a list of products and services necessary for human life support is formed - a consumer basket. Then the average consumer prices for this set for the past quarter are analyzed.
General principles for the formation of the living wage as a social and statistical indicator:
- the cost of living is set once a quarter, that is, quarterly based on a study of prices over the past period. For example, it is planned that for the 4th quarter of 2021 the PM will be determined in February 2021;
- The cost of living for the population is not the same; the amounts are different for children, pensioners and working adults. The legislator believes that representatives of these groups have different needs and different expenses;
- the main one is the cost of the consumer basket; it determines the amount of the subsistence minimum.
The subsistence minimum is widely used in social policy to assign additional payments (both as an income level and as the amount of additional payment).
