The minimum wage is the minimum wage that an organization or individual entrepreneur (employer) must accrue to employees for the month they have fully worked (Article 133 of the Labor Code of the Russian Federation). What is the size of the new minimum wage in the Moscow region from January 1, 2021?

The minimum wage in the Moscow region has been established since December 1, 2016 in the amount of 13,750 rubles (clause 1 of the Agreement on the minimum wage in the Moscow region between the Government of the Moscow region, the Union "Moscow Regional Association of Trade Union Organizations" and associations of employers of the Moscow region, concluded 11/30/2016 No. 118).

Since January 1, 2021, the minimum wage in the Moscow region has not changed or increased in any way. It remained in the amount of 13,750 rubles.

State employees of the Moscow region are guided by the federal minimum wage (from January 1, 2021 - 9,489 rubles).

Amount 13,750 rub. for the commercial sector, it is a guarantee that any employee, even without any qualifications, has the right to expect to receive a salary in this amount. In this case, it is assumed that the employee has worked for a full month and fulfilled the production plan.

In connection with the adoption of Federal Law No. 54-FZ of April 20, 2007 “On introducing amendments and additions to the Federal Law “On the Minimum Wage” and other legislative acts of the Russian Federation,” the procedure for establishing the regional minimum wage has been changed. Since September 1, 2007, the regional minimum wage is established by a tripartite agreement

, concluded between representatives of workers, employers and executive bodies of state power, and not by regional law. The minimum wage in a constituent entity of the Russian Federation may be established for employees of that constituent entity, with the exception of employees of organizations financed from the federal budget. The size of the regional minimum wage cannot be less than the federal minimum wage. The development of a draft regional agreement and the conclusion of the said agreement are carried out by a tripartite commission for regulating social and labor relations of the relevant constituent entity of the Russian Federation. Following the conclusion of a regional agreement on the minimum wage, employers who did not participate in the conclusion of this agreement will be invited to join it. If employers, within 30 calendar days from the date of official publication of the proposal to join the regional agreement, have not submitted a reasoned written refusal to join it, then the specified agreement is considered extended to these employers and is subject to mandatory execution.

In the event of a written refusal by the employer to accede to the regional agreement on the minimum wage, in accordance with Order No. 93 of Rostrud of the Russian Federation dated July 3, 2007, the organization will undergo a comprehensive audit of compliance with labor legislation.

How the minimum wage changed in the Moscow region until 2018

Minimum wage, according to Art. 133 of the Labor Code of the Russian Federation, should be no less than the subsistence level; this parameter was constantly increasing in order to somehow compensate for the increase in the cost of the consumer basket. Minimum wage in the Moscow region from January 1, 2021

The agreement concluded between the Government of the Moscow Region, representatives of the trade union association and employers established the minimum wage in the Moscow region from January 1, 2021 - 14,200 rubles.
This figure is higher than the federal average (12,130 rubles), but less than the minimum wage in Moscow - 20,195 rubles. The document applies to employers of any legal form and type of ownership, except for organizations that receive funding from the federal budget.

The minimum salary in the Moscow region in 2021 is provided by:

  • the budget of the Moscow region for those enterprises that receive funding from it, as well as income received from commercial activities;
  • funds from local budgets for organizations and enterprises that are financed by local budgets, as well as profits from business and other types of activities;
  • at the expense of private business's own funds.

Employers have the right to switch to the federal minimum wage of 12,130 rubles. To do this, you must not miss the 30-day period from the date of official publication of the new minimum wage in order to send a written refusal to apply the minimum wage indicator in the Moscow region for 2021.

Moscow region and federal minimum wages from January 1, 2018

From January 1, 2021, the federal minimum wage is 9,489 rubles. See “Minimum wage from January 1, 2021.” However, the “minimum wage” of the Moscow region is higher than the federal one. After all, regions have the right to set their own minimum wage, but not less than the federal one (Part 4 of Article 133.1 of the Labor Code of the Russian Federation).

We, the undersigned authorized representatives of the Government of the Moscow Region, the Union “Moscow Regional Association of Trade Union Organizations”, associations of employers of the Moscow Region, collectively referred to as the “Parties”, on the basis of the Labor Code of the Russian Federation, Federal Law of June 19, 2000 No. 82-FZ “On the Minimum Size wages”, Law of the Moscow Region No. 15/99-OZ “On Social Partnership in the Moscow Region” entered into an Agreement on the minimum wage in the Moscow Region (hereinafter referred to as the Agreement).

The parties agreed:

  1. Establish a minimum wage in the Moscow region from April 1, 2021 in the amount of 14,200 rubles.
  2. In accordance with Article 1331 of the Labor Code of the Russian Federation, the Agreement applies to employers - legal entities (organizations) and employers - individuals who have entered into labor relations with employees and operate in the Moscow region, with the exception of organizations financed from the federal budget.
  3. The Agreement comes into force on the date of signature by the Parties and is valid until the new Agreement comes into force.
  4. Control over the implementation of the Agreement is carried out in accordance with the legislation of the Russian Federation.
  5. The agreement is subject to official publication in the newspaper “Daily News. Moscow Region" and placement (publication) on the website of the Government of the Moscow Region in the Internet portal of the Government of the Moscow Region.
  6. The Agreement is drawn up in three copies having equal legal force, one for each Party.

How to compare the federal and Moscow region minimum wages in 2021

Employers in the Moscow region (organizations and individual entrepreneurs) must set a salary no less than the Moscow region minimum wage (RUB 13,750) only if they have joined the Moscow regional agreement. Those employers who, within 30 calendar days after the publication of the agreement, have not sent a written reasoned refusal to join to the labor authority of a constituent entity of the Russian Federation, will automatically join it. If such a refusal was sent, then the salary in the Moscow region from January 1, 2021 can be compared with the federal minimum wage (9489 rubles). If there was no refusal, then from January 1, 2018, rely on the minimum wage of the Moscow region - 13,750 rubles.

The minimum wage of the Moscow region, applied from January 1, 2021, already includes the tariff rate (salary) or wages under a non-tariff system, as well as additional payments, allowances, bonuses and other payments, with the exception of payments:

  • for working in harmful and dangerous conditions;
  • combining professions (positions), expanding service areas, increasing the volume of work;
  • night and overtime work, work on weekends and holidays.

In other words, for overtime work, you need to pay above the Moscow region minimum wage.

Compare the total payment amount for the month with the minimum wage before you withhold personal income tax. That is, a person can receive less than the minimum wage.

Include in the minimum wage all bonuses and rewards included in the remuneration system. The exception is regional coefficients and bonuses; they are calculated above the minimum wage.

Refusal of the new minimum wage for the Moscow region

Employers in the Moscow region (organizations and individual entrepreneurs) from April 1, 2018 must set a salary no less than the Moscow region minimum wage (RUB 14,200) only if they have joined the Moscow regional agreement. Those employers who, within 30 calendar days after the publication of the agreement, have not sent a written reasoned refusal to join to the labor authority of a constituent entity of the Russian Federation, will automatically join it. If such a refusal was sent, then the salary in the Moscow region from April 1, 2018 can be compared with the federal minimum wage (9489 rubles). If there was no refusal, then from April 1, 2021, rely on the minimum wage of the Moscow region - 14,200 rubles.

Possible fines for employers in the Moscow region

For wages below the minimum wage, fines are imposed without proper justification. The company, if the violation is the first, faces a fine from 30,000 to 50,000 rubles. If the violation is repeated – from 50,000 to 70,000 rubles. For an official, the sanctions are accordingly: a fine from 1000 to 5000 rubles. and from 10,000 to 20,000 rubles. or disqualification from one to three years. The same rules apply to an entrepreneur as to an official, only disqualification cannot be applied to an individual entrepreneur (clauses 1 and 2 of Article 5.27 of the Code of Administrative Offenses of the Russian Federation).

As you can see, from May 1, 2021, there has been a fairly significant increase in the minimum wage. For 1674 rub. (RUR 11,163 – RUR 9,489). Why did this happen? Why did they suddenly decide to increase the minimum wage from May 1? Let me explain.

The minimum wage was equated to the flow minimum earlier than planned

At the very end of 2021, Federal Law No. 421-FZ dated December 28, 2017 was adopted. They recorded that from January 1, 2018, the minimum wage will increase to 9,489 rubles per month. Moreover, starting from January 1, 2021 and thereafter annually from January 1 of the corresponding year, the minimum wage is established by federal law in the amount of the subsistence level of the working-age population as a whole in the Russian Federation for the second quarter of the previous year. In other words, starting in 2021, a mechanism has been introduced to bring the minimum wage to the subsistence level of the working population.

By Decree of the Government of the Russian Federation dated September 19, 2017 No. 1119, the cost of living for the working population is 11,163 rubles. Thus, one could expect that the minimum wage of 11,163 rubles would be established from January 1, 2021. However, the situation changed dramatically after V.V.’s statement. Putin. During a working trip to the Tver region, Vladimir Putin promised: the minimum wage in Russia will be equal to the subsistence level from May 1, 2018.

Thus, bringing the minimum wage to the subsistence level of the working-age population occurred earlier than planned - from May 1, 2018. The corresponding law has already been prepared and is awaiting submission to the State Duma.

The subsistence minimum is the cost of a conditional consumer basket, which includes a minimum set of food products, non-food products and services that are necessary to ensure human life. The cost of living also includes mandatory payments and fees.

The cost of living is approved at the end of each quarter, using numerous statistical data, including the inflation rate, to determine it. The federal subsistence minimum is set by the Government of Russia, and regional minimums are set by regional governments.

But what will the increase in the minimum wage from May 1, 2021 affect? What actions will employers need to take in connection with the increase in the minimum wage? We'll talk about this further.

New minimum wage and salary from May 1, 2021

The minimum wage is the minimum wage that an organization or individual entrepreneur (employer) must accrue to employees for the month they have fully worked (Article 133 of the Labor Code of the Russian Federation). However, keep in mind that an employee may receive less than the minimum wage in person - minus personal income tax and other deductions, for example, alimony. Accordingly, from May 1, 2018, it is impossible to pay less than 11,163 rubles.

It is worth noting that the salary of employees from May 1, 2021 may be less than 11,163 rubles. After all, the total salary, which includes (Article 129 of the Labor Code of the Russian Federation) cannot be less than the minimum wage:

  • remuneration for work;
  • compensation payments, including additional payments and allowances;
  • incentive payments (bonuses).

The total amount of all such payments from May 1, 2021 must be at least 11,163 rubles.

If, from May 1, 2021, the employee’s salary is less than the minimum wage (11,163 rubles), then the employer may be held accountable in the form of fines. The fine for an organization can range from 30,000 to 50,000 rubles, and if detected again - from 50,000 to 70,000 rubles. For a director or chief accountant, the liability may be as follows: for a primary violation, they may issue a warning or a fine of 1,000 to 5,000 rubles, for a repeated violation, a fine of 10,000 to 20,000 rubles. Moreover, they can be disqualified for a period of one to three years (Article 5.27 of the Code of Administrative Offenses of the Russian Federation).

Minimum wage in the regions from May 1, 2021

From May 1, 2021, regional authorities can establish in a special agreement their own minimum wage, which exceeds the federal minimum wage (Article 133.1 of the Labor Code of the Russian Federation). However, the regional minimum wage can be abandoned. For these purposes, you will need to issue a reasoned refusal and send it to the local branch of the Committee on Labor and Employment.

In accordance with Part 1 of Art. 133.1 of the Labor Code of the Russian Federation in a constituent entity of the Russian Federation, a regional agreement may establish a different minimum wage. It should not be lower than the minimum wage approved by federal law. That is, from May 1, 2021 - no less than 11,163 rubles (Part 4 of Article 133.1 of the Labor Code of the Russian Federation). Employers are considered to have acceded to the regional agreement on the minimum wage if, within 30 calendar days from the date of its publication, they have not sent a written reasoned refusal to join it to the Ministry of Labor of Russia. In this case, the organization is obliged to comply with all provisions of the regional agreement (Part 8 of Article 133.1 of the Labor Code of the Russian Federation). This means that the minimum wage established by the regional agreement is mandatory for the employer.

The minimum wage in 2021, from January 1, is 9,489 rubles per month (Article 3 of the Federal Law of December 28, 2017 N 421-FZ) and is set in an absolute amount.

The cost of living is intended to assess the standard of living of the population in Moscow. This indicator is calculated as the sum of the monthly cost of products in the consumer basket, as well as mandatory payments and fees.

The Moscow Government uses the cost of living in its activities for:

development and implementation of new social programs; calculation of state social payments; drawing up a draft budget for the city of Moscow, determining budget costs for the implementation of social programs of the city of Moscow and providing assistance to low-income Muscovites. Including travel costs for pensioners; development and implementation of measures for social protection of the population of the city of Moscow and urban social programs in the future. When the Moscow Region minimum wage does not need to be applied

Benefits

To calculate social benefits, use the federal minimum wage, not the regional one. Let us remind you that “minimum” social benefits are received by employees with earnings below the minimum wage or with short work experience (up to 6 months) (clause 1.1 of Article 14 of the Federal Law of December 29, 2006 No. 255-FZ).

Vacation pay

The federal, and not the regional, minimum wage should also be taken into account when calculating vacation pay. The average monthly earnings calculated for calculating vacation pay cannot be lower than the minimum wage (clause 18 of the Regulations, approved by Government Resolution No. 922 of December 24, 2007). Therefore, you need to compare the calculation result with this indicator. And if the comparison is not in favor of the employer, you will have to make an additional payment up to the federal minimum wage.

Insurance premiums for individual entrepreneurs “for themselves”

Insurance premiums for individual entrepreneurs “for themselves” for 2021 are also determined based on the federal minimum wage. In this case, you need to take the value set at the beginning of the year (RUB 7,500). However: from 2021, individual entrepreneurs’ contributions “for themselves” are no longer tied to the minimum wage. The Tax Code - in paragraph 1 of Article 430 - now spells out fixed amounts that all businessmen will have to pay throughout the year. And these fixed payments do not depend on the amount of income. And it doesn’t matter whether the businessman worked at a profit or at a loss. As a general rule, all individual entrepreneurs will have to pay such contributions to the Federal Tax Service budget.
