    The procedure for calculating value added tax is established by Chapter. Tax Code of the Russian Federation. In paragraph 1 of Art. 164 of the Tax Code of the Russian Federation determines that the following types of transport transportation are taxed at a rate of 0 percent:

    1. International transportation of goods using river, sea and mixed types of vessels, aircraft, as well as railway and road transport, if the point of departure or destination is located outside Russian territory;
    2. Domestic transportation provided that the point of departure or destination is in Crimea or Sevastopol, as well as in the Kaliningrad region;
    3. Transportation of goods that were previously placed under the customs transit procedure;
    4. Transportation of petroleum products, oil and gas by pipeline on the territory of the Russian Federation or beyond its borders;
    5. Transportation of passengers and baggage in the following situations:
    • When the point of departure or destination is outside Russian territory;
    • Railway transport in suburban traffic across Russia;
    • Railway transport on long-distance trains within Russian territory;
    • By air, if the point of departure or destination is located in Crimea, Sevastopol, in the Kaliningrad region or in the territory of the Far Eastern Federal District, as well as outside the territory of Moscow and the Moscow region.

    If one of the above situations occurs, the carrier issues an invoice with a 0% VAT rate.

    Next, you will need to confirm the validity of applying this tax rate to the Federal Tax Service inspection within 180 calendar days from the date of affixing the customs mark in the shipping documents (clause 9 of Article 165 of the Tax Code of the Russian Federation). If the taxpayer fails to meet the 180-day deadline, he will have to pay VAT in the amount of 20% of the cost of transportation.

    If the full package of documents has not been collected by the next deadline for submitting VAT reports and, as a result, the 0% rate during this period is not confirmed (but the 180-day period has not been violated), a discrepancy will arise between the income tax and VAT returns. Upon receipt of a request from the tax office, you will need to disclose the reasons for the identified differences.

    In the package of supporting documents in accordance with Art. 165 of the Tax Code of the Russian Federation includes:

    1. Copy of the contract;
    2. Copies of all shipping and transport documents. In particular, CMR, which is an analogue of the Russian TTN and contains information about the cargo, route and vehicle;
    3. A copy of the customs declaration with marks from the customs authorities.

    Required documents

    To obtain a license to transport passengers of more than eight people, you must contact the branch of the Federal Transport Service. Here is a set of documents that you need to have on hand:

    • Certificate of registration of an individual entrepreneur or LLC and its charter, confirmation of tax registration.
    • Extracts from unified state registers.
    • Confirmation of the legal address of the enterprise and its bank details.
    • Agreement for renting a parking lot or garage.
    • Vehicle maintenance agreement.
    • Agreement for medical examinations of drivers before setting out on a route.
    • Passport of the director of the enterprise.
    • A complete set of driver documents (licence, work record, medical certificate).
    • Confirmation of car registration in the traffic police.
    • OSAGO for every car.
    • Documents for the car (PTS, inspection certificates).

    Procedure

    If the business is organized correctly, the route business for transporting passengers can quickly pay off and begin to generate income. In addition to the set of documents to start route transportation, you will need:

    • Minibuses.
    • Drivers.
    • Premises for garage and office.

    But first things first:

    1. The first thing you need to worry about is choosing a route. Here you can wedge yourself into the existing passenger flow and fight with competitors, or try to master a new one in the fight against bureaucracy. In general, it is impossible to do without careful calculation and some risk.
    2. Then calculate the size of the required investments and find their sources.
    3. Selection of cars. You can choose between cheap and easy to repair and maintain, but quickly deteriorate “Gazelles” and more expensive and reliable imported models.
    4. Registration of compulsory insurance and organization of maintenance and repair of minibuses.
    5. Office and garage rental.
    6. Recruitment. You will need: two drivers per minibus, a dispatcher, an accountant and a mechanic. This is the required minimum.

    Rules for transporting passengers in a minibus in 2019

    To ensure the safety of passengers, it is necessary to strictly follow the transportation rules approved by government decree. We can recall the most important of them:

    • Minibuses stop for boarding or disembarking passengers at places designated as stops or at the request of citizens, if this does not contradict road rules.
    • The driver of the minibus is obliged to comply with traffic rules, follow strictly the established route, and board and disembark passengers.
    • It is prohibited to carry more than the established number of passengers.
    • It is prohibited to drive the minibus with the doors not tightly closed.
    • It is prohibited to drive a car to a driver who is not indicated on the route sheet.
    • The fare is set on the basis of approved tariffs.
    • The minibus driver accepts payment and issues tickets.

    Starting a route business is an expensive business. To start, you will need large investments, the amount of which, of course, will depend on the scale of the undertaking.     The bus company carries out passenger transportation, which is not subject to VAT (clause 7, clause 2, article 149 of the Tax Code of the Russian Federation, i.e. on regulated routes and at regulated tariffs).     According to subparagraph 7 of paragraph 2 of Article 149 of the Tax Code of the Russian Federation (hereinafter referred to as the Code), services for the transportation of passengers by public urban passenger transport (except for taxis, including minibuses) are not subject to taxation (exempt from taxation). For the purposes of this article of the Code, services exempt from value added tax are services for the transportation of passengers by public urban passenger transport, subject to the following conditions: transportation of passengers is carried out at uniform tariffs established by local governments, including the provision of all travel benefits , approved in accordance with the established procedure.

    If this condition is not met, the services provided for the transportation of passengers by public urban passenger transport, exempt from VAT on the basis of paragraph 2 of Article 149 of the Code, are not recognized.

    Let's say a few words about VAT exemption. It is provided for the transportation of passengers by public urban passenger transport (except for taxis, including minibuses) under uniform conditions for the transportation of passengers at uniform fares established by local governments, including the provision of all travel benefits approved in a certain manner (Clause 7, Clause 2, Article 149 of the Tax Code of the Russian Federation).
