Does the law allow receiving wages in cash in Russia in 2021?

There are no specific restrictions on the issuance of wages in cash to workers of the Russian Federation. Each organization or enterprise establishes a procedure for issuing wages:

  • this procedure is recorded in internal labor documents;
  • it is necessary to indicate its points in the employee’s employment contract with the administration.

This procedure determines how the employee’s salary will be paid.
In cash through the cash register or by transferring funds to the employee’s bank card. Both forms of payment are subject to certain restrictions:

  • source of funds;
  • settlement periods;
  • the procedure for maintaining accounting entries;
  • registration of cash order, etc.

It is worth noting that this information applies only to cases of receiving an official salary. Unofficial employment in the Russian Federation is prohibited and punishable by law.

Can an employer refuse to pay wages in cash?

The employer is obliged to regularly pay wages to its employees. At the same time, he himself decides in what form - cash or non-cash - to do this. An employee may ask to change the form of payment, but the employer is not required to agree to this.

Judicial practice shows that in most cases the courts do not satisfy the demands of employees to switch to cash payments. The main reason is that the employee initially signs an application for the transfer of salary to a bank account upon employment. Or this is immediately stipulated in the labor or collective agreement.

Moreover, if the employee did not sign an application to transfer his salary to the bank, and such a procedure is not enshrined in an employment or collective agreement, the employer cannot refuse to pay him a salary in cash. In fact, without these documents, the company did not even have the right to open a salary account.

The company may refuse to pay employees wages in cash if a decision has been made to liquidate the cash register. That is, the company uses only non-cash funds.

How to register to receive wages through the cash register?

This is an absolutely free document and is written arbitrarily.
It is important to indicate in whose name the request is being made. The application must contain the following information:

  • Full name of the head of the organization and his position.
  • Employee data, his position.
  • The text of the application itself, which states that the employee asks to receive his salary and other payments at the cash desk of the organization (company name), starting from a certain period (specify the date or month).
  • The date when the application was drawn up and the employee’s signature with a transcript.

It is important that the employer cannot force not only to receive wages on the card, but also to a specific bank in the first place. Often workers refuse bank payments precisely because they do not like the option offered by the employer.

In this case, you need to write an application either to transfer money to the bank account proposed by the employee, or simply give it in cash at the cash desk.

The employer should be aware that, according to Labor Law, an employee has the right to repeatedly change the form of receiving his salary. This means that the application can be submitted more than once, changing the method of receipt from cash to a bank card and vice versa.

Many accounting employees and heads of organizations justify their refusals by the fact that it is expensive for the company to transfer money to third-party cards or issue them in cash. This does not concern the employee. If an employee is comfortable receiving wages in cash, then the company should accommodate him. The main thing is to simply draw up the document.

If the employer refuses and does not cooperate, then the employee has every right to appeal to the Labor Inspectorate or directly file a claim in court. In this case, the court will most likely take the side of the worker and force the employer to pay wages in cash directly at the place of work, as prescribed in Art. 136 of the Labor Code of the Russian Federation.

Why is it more profitable for an employer to pay wages by bank transfer?

Typically, it is more profitable for companies to transfer wages to employee cards as part of a salary project. Firstly, making a non-cash transfer is easier than collecting employees and giving them cash. Secondly, the salary project provides a number of advantages to the company, for example, they do not charge a commission for transferring salaries or give a discount for servicing the current account. And when issuing cash, the employer will still have to spend money on a commission for withdrawing money.

Important! Unscrupulous entrepreneurs prohibit employees from even changing the bank where they receive their salary. It is illegal. Even if the company has a salary project in bank A, the employee can demand that the salary be transferred to his card in bank B.

The company's cash withdrawal costs should not in any way affect the employee's convenience in receiving their salary.

Can an employee ask for wages to be paid from the cash register?

According to Article 136 of the Labor Code of the Russian Federation, wages can be paid either at the place where work duties are performed (that is, in cash, or to bank details (that is, to a card).

The two parties (employee and employer) must decide together which method of mutual settlements will be used in a particular situation. The employee has the right to ask for cash.

The employer does not have the right to refuse cash payments, explaining his refusal by the fact that all staff receive their salaries on the card. An employee has every right to ask for wages to be paid not on a card, but in cash at the cash register.

For many citizens, this payment method is more reliable and understandable; not everyone wants to interact with banking structures and ATMs.

Therefore, if an employee wants his work to be paid through the cash register, then he must declare this to the employer, who, in turn, must satisfy such a request, especially since there is nothing complicated in this process.

If for some reason in the future a person will not be able to receive his salary at the cash desk, for example, due to departure, illness or vacation, then he can entrust this right to his representative on the basis of a power of attorney -.

Do I need to write an application to receive a salary in cash?

Yes, the employee needs to put his request in writing in the form of a simple handwritten statement.

The employer needs such a document to justify the cash payment of wages to a specific employee.

The document is very simple to draw up; it can be drawn up on a regular sheet of paper by hand or compiled on a computer and then printed out.

The prepared application form must be signed in your own hand. Moreover, the signature must be handwritten. Next to it is a transcript of the signature and the date the document was drawn up.

How to properly issue a notice to an employer?

For registration, just take a regular A4 sheet. In the upper right corner you should indicate the full name of the head of the organization and add the company name next to it.

Personal name and position are written below.

After the title, the main text is written containing a request in the form of receiving wages in cash at the cash register.

The application may contain a request for payment of salary in cash for a specific month, indicating the reason why it is not necessary to transfer it to a bank card. You can request payment of money through the cash register on an ongoing basis as a convenient way of mutual settlements.

It is not necessary to indicate the reason for his request; the employee has the right to ask for a cash payment for wages, so there are no violations on his part in this case.

The completed text should be signed and submitted to the responsible person at the place of work, for example, an accounting employee responsible for mutual settlements with personnel.

How to issue a salary in cash: procedure and accounting entries

Salaries must also be paid in cash twice a month. The interval is no more than 15 calendar days between payments. To receive a salary, the employee must go to the organization's cash desk.

To process the payment of wages, use a payslip in form T-49 or a payslip in form T-51.

The algorithm for issuing money is simple:

  • the manager or chief accountant signs the payroll slip and hands it to the cashier;
  • the cashier carefully checks the presence of all signatures and prepares the required amount;
  • cash is given to the employee: to establish identity, the cashier may ask for a passport;
  • the cashier passes the payment document to the recipient for signature;
  • the employee receives his salary and recalculates it without leaving the cash register.

When issuing wages, the accountant makes only one entry: Dt 70 Kt 50 .

Money for salary payments can remain in the cash register for up to 5 days, even if the cash register limit is exceeded. During this time, you need to manage to calculate all employees. The remaining salary must be deposited, that is, returned to the bank. Then the accountant makes the following entries:

Dt 70 Kt 76.4 - uncollected wages deposited;

Dt 51 Kt 50.1 - the deposited salary is transferred to the current account.

At the first request of the employee, the deposited amount must be returned. The accountant will make the following entries:

Dt 50.1 Kt 51 - money was received from the current account to the cash desk for payment of deposited salaries;

Dt 76.4 Kt 50.1 - the employee was given deposited wages.

In what cases is it prohibited to pay wages in cash?

Paying wages in cash is prohibited only when paying foreigners. The range of cash payments with foreigners is limited by Part 2 of Art. 14 Federal Law dated December 10, 2003 No. 173-FZ, and wages are not included in this list. The position that foreigners can only be paid wages in non-cash form was confirmed by the tax authorities in Letter No. 3N-4-17/15799 of the Federal Tax Service dated August 29, 2016.

Paying wages in cash to a foreign person is a violation of currency laws. Fine under Part 1 of Art. 15.25 of the Administrative Code of the Russian Federation will be 75-100% of the amount issued.
