Opening an individual entrepreneur on your own in 2021 - an overview of all methods

Individual entrepreneur is a legal entity or an individual

Due to the simplicity of registration, entrepreneurship is a very popular form of activity.
An entrepreneur is an intermediate stage between an individual and a legal entity. An entrepreneur is an entity that independently carries out the chosen type of activity on an ongoing basis.

This is an individual who has gone through the registration procedure as an economic entity. What distinguishes an entrepreneur from an individual is that he is an independent entity that determines its activities, a taxpayer based on the results of its activities, etc. An individual has the right to work only on the basis of an agreement signed with the employer.

If a person starts doing business (he has the right to do so), then the legislation establishes the obligation to register an individual entrepreneur.

On the other hand, an individual entrepreneur cannot be recognized as a legal entity, since when carrying out its activities it does not bear the full scope of duties and responsibilities provided for companies.
Attention: independent activity of an entrepreneur is allowed after his registration has been completed.
It is from this moment that the provisions of civil legislation, as well as other regulations governing commercial activities, begin to apply to him. And for illegal commercial activities they can be held accountable. However, there are areas of economic activity that can only be carried out by legal entities. They are not available to individual entrepreneurs.

Step 2. Enter the full name of the future individual entrepreneur, TIN and his address

The next point will be to correctly, in accordance with the passport of a citizen of the Russian Federation, enter the full last name, first name and patronymic.

Attention! If payment will be made using a receipt through a bank, then the TIN does not need to be entered. For non-cash payment, the TIN of an individual is required.

What to do if a citizen has not yet received a TIN? In this case, payment can be made through a bank branch. An individual can obtain a TIN either by submitting a corresponding application, or it will be assigned automatically upon registration of an individual entrepreneur.

After you enter the TIN and full name of the citizen, you will need to fill in his address at the place of registration. To do this, a new window will open when you click on the address field. After checking the entered data, click the “Next” button.

Step 3. Select a payment method

After you have checked the entered data again, click the “Pay” button. If you notice an error, click the “Back” button and edit the form. If everything is fine, then select the payment method.

If “Cash” was selected as the payment method, the system will generate a receipt for payment through the bank.

If “Cashless payment” was selected as the payment method, the system will open partner banks with which you can pay with a plastic card.

Attention! If you pay state fees online, you will need to request a payment receipt from the bank through which the payment will be made.

Next, the receipt will need to be presented when submitting the main package of documents when registering an individual entrepreneur.

In what case is an individual entrepreneur more profitable than an LLC?

Before making his choice, an individual must weigh all the positive and negative aspects, and after that only make his choice. The entrepreneur can take over the management of the activities without involving additional hired employees.

Attention: many businessmen give preference to individual entrepreneurs - they are attracted by the simple setup procedure and low costs. It is believed that entrepreneurship is also profitable if the number of employees is small.

General rules

The state fee for registering an individual entrepreneur is 800 rubles, but in some cases you can get a discount or register without paying a fee - this depends both on the method of submitting documents and on the option of paying the fee itself.

First of all, you need to decide how you plan to submit documents. In 2021, there are the following methods:

  • Personally at the Federal
    Tax Service (Federal Tax Service). The duty in this case is paid at 100%.
  • Through the MFC
    (Multifunctional Center). There is no need to pay a fee.
  • In electronic form
    through a specialized service (an electronic signature is required). There is no need to pay a fee.

    registered mail. The duty in this case is paid at 100%
  • Through a notary
    . In this case, he will sign the application with his digital signature and there will be no need to pay the fee.

From 2021, payment of the fee through the government services portal will provide a 30% discount on the fee amount.

From January 1, 2021, it became possible not to pay the fee for registering an individual entrepreneur

.
However, you can use this right only if you submit documents through the MFC, a notary, or electronically, having certified them with your digital signature
.

The fee must be paid before submitting documents for registration. There is no expiration date for such payment, so if you have already paid the fee and registration is postponed, don’t worry, you won’t have to pay it again. But if you change your mind about registering an individual entrepreneur, you can apply for a refund of the fee only within three years.

You can pay the state fee in the following ways

:

  • Through services on the Federal Tax Service website and the State Services portal
    . One of the most convenient payment methods is that the details are entered automatically by the services; you only need to fill in the fields with your data. There is no transfer fee
  • In Internet banking
    . In the personal accounts of many modern banks, payment of duties and fines is available.
  • Cash at a bank branch
    . To do this, you will need to print a receipt with ready-made details from the Federal Tax Service website.
  • Via terminal/ATM
    . Many of them charge a commission, in addition, you will either have to search for the required inspection using the Taxpayer Identification Number (TIN) or find it using a pre-printed receipt using a barcode
  • Through mobile applications
    . Currently, there are many applications through which you can pay fines, taxes and duties by card or from an electronic wallet. Usually it is quite easy to find the necessary details in them, but the commissions are also the highest. In addition, you should carefully read reviews about the application - there are fraudulent programs that simply write off money from the card without transferring anything anywhere

Pros and cons of being an entrepreneur

There are the following advantages of entrepreneurship:

  • Registration with the registration authorities follows a simplified procedure. It is enough to fill out and submit to the Federal Tax Service an application drawn up in the prescribed form. You only need to attach to it a copy of your identity document and a receipt confirming payment of the state duty. The registration fee is 800 rubles, which is significantly less than the state duty when registering an enterprise. In addition, the registration procedure through government services is available. In this case, the fee will be only 560 rubles.
  • An entrepreneur does not need to register in all places where he carries out his activities; he can register in one region and work in others. In this case, he does not need to carry out any actions to register.
  • Existing legal norms for an entrepreneur establish an order of magnitude lower liability for violation of the law.
  • Also, individual entrepreneurs are given the right to carry out accounting according to a simplified scheme. This is not affected by the applicable tax systems. The tax accounting registers provided for by law are required to be filled out.
  • Individual entrepreneurs under the general regime pay taxes in quantity and amounts significantly less than a legal entity.
  • If a subject decides to close a business, he can do this in a short time, because he does not need to go through the liquidation procedure provided for legal entities. In addition, the fee for deregistration as an individual entrepreneur is only 160 rubles.

Do not forget about the negative aspects that may arise when carrying out activities as an individual entrepreneur, these include:

  • Entrepreneurs do not have the opportunity to attract outside investment to develop their business. This is due to the fact that the individual entrepreneur does not have an authorized capital, and this person cannot increase it by attracting additional founders.
  • If an entrepreneur incurs a debt in the process of doing business, he will be liable for it even if the individual entrepreneur is closed.
  • An entrepreneur must submit all declarations and reports at the place of his registration. This rule is quite problematic to follow if the individual entrepreneur does business in another region. The problem is partly solved by using electronic document management when sending reports. But do not forget that inspectors of the Federal Tax Service can call taxpayers to give explanations. Then the entrepreneur will have to go to his place of registration.
  • Certain types of activities defined by law are not available to an entrepreneur, that is, there are restrictions on types. All such directions are established in the relevant legal acts.
  • An individual entrepreneur must understand that he will not be able to fully sell his business to another person, as can be done with an LLC. Only property is available for transfer, but various permits are valid only in relation to a strictly defined person. Therefore, if necessary, they will have to be issued again.
  • Citizens registered as individual entrepreneurs have the obligation to calculate insurance premiums for themselves. Fixed payments will need to be paid to the budget even if there is no actual activity, but the individual entrepreneur is open.
  • If an entrepreneur is an employer, then he is required to register in this status with the Social Insurance Fund.
  • An entrepreneur must manage all processes independently when carrying out his activities.

Fill out the receipt for payment of the duty

The recipient of the funds is the registering authority - the Federal Tax Service of the Russian Federation. In this regard, the easiest way is to issue a receipt for payment of the state duty for registering an individual entrepreneur on the official website of the tax service in the “Payment of taxes and duties” section. To do this you need:

  1. Sequentially select the sections “Individuals”, “Payment of state duties”.
  2. In the new window, select the type of payment - “State duty for registration of an individual entrepreneur”, the name of the payment - “State duty for registering a private individual entrepreneur as an individual entrepreneur (800 rubles)”, type of payment - “Payment”. The payment amount will be set automatically. Go further.
  3. Fill in the details of the recipient of the duty, go further and fill in the details of the payer. Click "Pay".

Important! According to Part 1 of Art. 45 of the Tax Code of the Russian Federation, the taxpayer is obliged to independently fulfill the obligation to pay tax. As the Constitutional Court of the Russian Federation explained in its ruling No. 41-O dated January 22, 2004, this means that the taxpayer must pay from his own funds and on his own behalf. This rule, by analogy, is applicable to the payment of state duty, therefore, when entering the payer’s details, you must indicate your full name. future IP.

  1. In the new window, select “Generate a payment document”, after which an electronic receipt will be automatically downloaded. It can be printed or shown to a bank employee on the screen of a phone or other device.

Reasons for refusal of registration

Registration of individual entrepreneurs in 2021 is carried out in the same way as in previous years. An individual must submit an application and a receipt with the state duty to the Federal Tax Service. Officials of the Federal Tax Service examine the received document for a certain period, after which they make a decision - to open an individual entrepreneur or refuse registration.

The provisions of the regulations establish the following situations when an individual may be refused registration as an individual entrepreneur:

  1. If errors are found in the submitted application due to which the registration procedure becomes unavailable.
  2. The application does not include the required document forms for this case - there is no copy of the passport or a receipt for payment of the state duty.
  3. When submitting an application, the territorial jurisdiction of the registration authorities was not observed. For example, an individual entrepreneur submitted documents for registration not according to his registration, but at the place of doing business.
  4. If a citizen who has declared his desire to become an individual entrepreneur is already registered as an entrepreneur, that is, his previous individual entrepreneur has not been closed.
  5. When the citizen who sent the application for registration has not yet reached the age of majority or is considered incompetent.
  6. When a court determines that a future entrepreneur is prohibited from engaging in entrepreneurial activities as a punitive measure.
  7. In a situation where the previous business was closed forcibly. In this case, an individual cannot register as an individual entrepreneur for one year.
  8. When the area of activity that the individual entrepreneur declares is available only to legal entities.

The tax authority that refused to register an individual entrepreneur must reflect the reason for its refusal in the appropriate document.

Important: starting October 1, 2021, the entrepreneur has the opportunity to adjust the data specified in the application and again send this form to the Federal Tax Service using the old payment receipt.
An individual entrepreneur can use this case only once within three months from the date of receipt of the refusal to register.

What is the amount and conditions for collecting the duty if we pay again?

In some cases, the tax service may refuse to register an entrepreneur. For example, if less than a year ago a citizen was unable to pay off his debts and was declared bankrupt (Part 4, Article 22.1 of Law No. 129-FZ). After a year, bankrupt status is no longer a basis for refusal of state registration, and the citizen can again try to obtain individual entrepreneur status. To do this, he will need to re-assemble the package of documents, and when applying directly to the Federal Tax Service, also pay a fee.

But there is an exception. According to clause 38.1 of the Administrative Regulations, approved. By order of the Ministry of Finance of the Russian Federation dated September 30, 2016 No. 169n, refusal to register, among other things, may be due to failure to submit the necessary documents to the tax authorities, their execution not in the established form, or in violation of the requirements for registration.

For example, in violation of clause 1.1 of the Requirements for the preparation of documents submitted to the registration authority (Appendix No. 20 to the order of the Federal Tax Service of the Russian Federation dated January 25, 2012 No. ММВ-7-6 / [email protected] ), the application is filled out with a red pen, not a black one colors or not in the form P21001 (Appendix No. 13 to the same order).

In these cases, you can submit new documents to the Federal Tax Service once without paying a state fee, provided that no more than three months have passed since the refusal of registration.

What types of activities do not fall under individual entrepreneurs in 2021

Regulatory acts regulating certain areas of activity in the economic sphere establish what types an entrepreneur cannot carry out. For this area it will be necessary to open an LLC.

These include:

  • Creation and wholesale and retail sale of finished products containing alcohol.
  • Production and sale of products containing narcotic and psychotropic substances.
  • Production of medicinal products.
  • Air transportation.
  • Production and repair of aviation equipment.
  • Activities related to space.
  • Manufacturing, sales and other activities related to the handling and use of weapons and ammunition.
  • Notarial activities.
  • Operation of investment funds.
  • Lending activities.
  • Insurance activities.
  • Private security services.
  • Production of pyrotechnic products.
  • Works on industrial safety.
  • Sales of electricity.
  • Search for work for citizens outside of Russia.

How to prepare a receipt

The easiest and fastest way to prepare a receipt for individual entrepreneur registration in 2021 is to use the special service of the Federal Tax Service. First, you need to choose where you will apply for registration - to the tax office or to the MFC. Receipt details will be different for different government agencies. Next, the program will prompt you step by step to fill in the fields and print a ready-made payment document.

A sample receipt can also be obtained from the tax office, where registration activities will take place. Here you need to keep in mind that opening an individual entrepreneur in the locality where you live is not always possible.

Typically, a large city or region has one or two specialized inspectorates that carry out registration of business entities. Even in a metropolis like Moscow, you can only register an individual entrepreneur in 2021 with the 46th Federal Tax Service Inspectorate. That is why it is convenient to use a wide network of multifunctional centers (MFCs), which accept documents from the applicant and themselves send them for registration.

If the details of the receipt do not correspond to the government agency that accepts documents for opening a business, then registration will be denied. Thus, it is necessary to correctly enter all the necessary information into the payment document and not make mistakes in it.

How can I register?

There are several ways to submit documents for business registration.

On one's own

This is the easiest way to submit documents for registration, and it usually does not require any additional investment. An individual must independently complete an application and pay the fee. The application form can be purchased at a printing house, downloaded from the website and printed, or filled out directly on the computer.

The collected documents are transferred to the Federal Tax Service at the place of registration of the person. This is done by personal appearance, via mail or the Internet. Registration is also available through MFC centers, where the procedure period has been reduced to 3 days since 2018.

Some authorities have now stopped receiving paper documents for registration. Therefore, before visiting a government agency, it is advisable to clarify whether it is possible to submit forms from them.

Via Internet services

There are several services on the Internet that offer the service of preparing an application for registration:

  • Nalog.ru - makes it possible to fill out an application in the P21001 format. Next, the form is printed and submitted in any available way to the registration authority;
  • Service "MoeDelo";
  • Service "Contour Elbe";
  • Service "Regberry";
  • Service "Sky";
  • etc.

Attention: as a rule, these services do not send an application to the tax office. It can be printed and submitted manually, or signed with an electronic digital signature and sent using the State Services portal.

Through banks

Many commercial banks currently provide a service for registering a business with the subsequent opening of a current account. They take full responsibility for preparing documents and submitting them to the government agency.

As a rule, the client must sign documents electronically using an electronic signature, after which they are sent for registration using a special system.

However, not all banks currently offer turnkey registration. Some simply prepare the necessary documents, and their transfer to the tax office is already carried out directly by the entrepreneur.

Through law firms

Many law firms offer turnkey registration of individual entrepreneurs as a service. It turns out that this service is provided on a paid basis and in a short time.

This method will allow the future entrepreneur to completely avoid the registration procedure, but he will have to pay for the services of this type of company. In addition, in order for a representative of the company to submit a package of documents for registration, it will be necessary to issue a power of attorney for him.

What changed in 2019-2020

Starting from 2021, by decree of the President, the state duty paid when registering LLCs and individual entrepreneurs was canceled if all documents are generated electronically. If documents are submitted as usual, you will still have to pay a fee.

There is no opportunity to reduce this amount, unlike, for example, the state fee for obtaining a driver’s license. You can make a payment in several ways:

  • through special services on the website or application of the Federal Tax Service of the Russian Federation, on the State Services portal;
  • through an ATM or terminal for making utility bills, paying fines, taxes and duties;

Registration of individual entrepreneurs in 2021: necessary documents and actions

Registration of individual entrepreneurs step-by-step instructions will help if you decide to draw up and submit documents yourself.

Step 1. Select activities

If an individual decides to start an activity as an entrepreneur, he already knows what kind of activity he will be engaged in. At the same time, he can choose several directions, but one of them must be designated as the main one.

When the application is filled out, these areas of activity must be indicated in it using the current OKVED2 codes. It is recommended to reflect all possible types of work on the form so that you do not have to make changes to the registration in the future.

Step 2. Fill out the application form P21001

The tax authority registers an individual as an entrepreneur based on a submitted application in the P21001 format.

You can compile this document manually on a paper form, or fill it out using a computer. In each case, the data must be entered according to the instructions, observing all established rules and avoiding any errors.

Therefore, to draw up an application, it is recommended to use special Internet services or accounting programs.

If the application is drawn up on a computer, then you must set the font for the characters to Courier New with a size of 18pt.

If data is entered by hand on a paper form, then this must be done only with a black pen, and only printed symbols must be used. In this case, each letter or sign is written in a separate cell.

The original application form includes sheets that apply to all cases. When actually filling out, only those that are necessary should be used. Blank pages from the application are removed and are not submitted for verification.

Important: It is prohibited to make corrections to the form. If an error is found in the document, then this sheet must be rewritten again.

Step 3. Prepare the necessary package of documents

The procedure for registering a business is quite simple and does not require the preparation of a large package of documents:

  • Compiled application in format P21001;
  • Full copy of passport;
  • A receipt indicating that the state duty has been paid.

In case the documents are transferred by an authorized person:

  • A power of attorney drawn up by a notary for the transfer of documents and receipt of the result;

If a future individual entrepreneur immediately wants to change the tax calculation system:

  • Application for transition to a special tax regime (STS, PSN, UTII);

If a foreigner wants to become an entrepreneur:

  • Notarized translation of all pages of his passport;
  • A copy of the received permit to stay in Russia.

Attention: when submitting documents through the MFC, an application for the transition to simplified tax regimes will need to be submitted to the Federal Tax Service after receiving documents on business registration.

Step 4. Pay the state fee

When submitting documents for registration of an entrepreneur, payment of the state fee is a mandatory requirement. Its size is now 800 rubles.

If the paperwork is completed using the State Services portal, then you can also transfer the payment through it. In this case, the applicant will be given a discount, resulting in the fee amounting to 560 rubles.

Also, the Federal Tax Service website makes it possible to generate a receipt for payment of the duty through a bank, or pay it immediately on the spot using electronic money. There is no discount for this payment method.

For any method of paying the fee, a copy of the receipt must be attached to the package of documents. If an error was made in the documents and the government agency refused to carry out registration, then when resubmitting them you will need to pay the fee again (valid until October 1, 2021).

Attention: this procedure was canceled on October 1, 2018 - starting from this date, the paid fee can be used one more time within 3 months from the date of refusal.

Step 5. Submit documents

You can submit the collected documents for verification in one of the following ways:

  1. Upon personal visit to the inspection. It is necessary to clarify the possibility of using this method, since in some regions documents from the Federal Tax Service are sent to the MFC ;
  2. Upon personal appearance at the MFC “State Services”;
  3. When using the Internet portal "State Services" - this method requires an electronic digital signature;
  4. When using the tax authority’s Internet portal, this method requires an electronic digital signature;
  5. By mail with the described attachment. For Moscow, shipping by DHL or Pony Express courier service is also available.

Attention: if documents are submitted in person to the Federal Tax Service or MFC, the employee receiving them must issue a receipt for receipt of the forms.

Step 6. Getting the result

The Statement of the World in the World üíîão ïðäïðèíàtåëÿ, ïàñïîòïè ïå÷àòü
Currently, the registration authority reviews documents within 3 days. Moreover, this period is valid for all registration methods.

Thus, changes in the current legislation, as well as the organization of the exchange of documents between the MFC and the tax authorities, currently allow registration by this method in the same time.

If the forms are successfully reviewed, the newly minted entrepreneur receives the following documents:

  • Notification of registration using form No. 2-3-Accounting. This document is drawn up on plain paper with the seal of the registering authority. OGRIP forms are currently not issued as before.
  • Extract from the Unified State Register of Individual Entrepreneurs in format P60009;
  • A form with the TIN code (if a request for its assignment was also made when submitting documents).

Attention: if the documents do not pass the verification, the applicant is given a written refusal with justification for refusing registration. He can issue them again and resubmit for verification.

Expenses for opening an individual entrepreneur

Costs at the stage of creating a business can be divided into mandatory and additional. Mandatory expenses include only state duty. This is the only payment without which it will be impossible to open an individual entrepreneur. Additional costs include the following:

  • Notarial services.
  • Post services.
  • Purchasing an electronic digital signature.
  • Services of professional registrars.
  • Managing individual entrepreneurs (accountant services).
  • Making a seal.
  • Opening a current account.
  • Purchasing an online cash register.

Let's take a closer look at each of the points to understand how much it costs to open an individual entrepreneur and what the price of registering a business consists of.

State duty for opening an individual entrepreneur

The state duty, as mentioned above, is the only mandatory payment, without which opening an individual entrepreneur is impossible. It is transferred to the details of the registration authority for reviewing the documents of the future entrepreneur. That is, the applicant does not pay for the fact of registration itself, but only for having his documents reviewed by the Federal Tax Service. Few people know that if registration is refused, the state duty is not refunded. The documents were studied, the decision was made (even if not in favor of the individual entrepreneur), the service was provided, which means there is nothing to return.

The fee for registering an individual entrepreneur in 2021 is 800 rubles. When submitting documents electronically through the State Services portal, the discounted fee will be 560 rubles. In addition, from January 1, 2019, you can open an individual entrepreneur completely free of charge. To do this, you need to issue an electronic signature and submit documents in electronic form through the website of the Federal Tax Service or State Services.

If the tax office still refuses to register an individual entrepreneur, he will have a chance to re-submit the documents without additional payment of state duty. But this only applies to those cases where the applicant was denied registration due to errors in the documents. The entrepreneur will have three months to correct the violations. The changes that approved this benefit came into force quite recently - on October 1, 2021. Previously, the state fee for registering an individual entrepreneur was paid regardless of the reason for the refusal.

Notarial services

These expenses are not mandatory, but may arise if the individual entrepreneur is unable to submit an application for registration on his own. This situation may arise if an entrepreneur lives in another city, is sick or does not have time to visit the tax office. In this case, he can send registration documents to the Federal Tax Service by mail or submit them through a representative. In both cases, you must pay for notary services:

  • according to the assurance of application P21001 - from 500 to 1,200 rubles.
  • upon certification of a copy of the passport - from 200 to 500 rubles.
  • for drawing up a notarized power of attorney (if documents will be submitted through a representative) - from 500 to 1,500 rubles.

Thus, if an individual entrepreneur decides to submit documents by mail, he will need to pay the notary an average of 700 to 1,700 rubles. If through a representative, then the price of notarization services will cost the applicant in the amount of 1,200 to 3,200 rubles.

Post services

If the future entrepreneur decides to send documents to the registration authority by mail, then he will need to pay additionally for postal services, on average about 200 rubles.

Registration of an electronic digital signature

Registration of an individual entrepreneur when submitting documents to the tax office in electronic form will require an electronic digital signature. Its cost is about 3,000 – 3,500 rubles. It is not profitable to issue an electronic signature for registration alone, but it is worth doing if the individual entrepreneur will use it in the future. Especially when you consider that since 2019, electronic registration of individual entrepreneurs is exempt from paying state fees in general.

Professional registrar services

If a future entrepreneur does not have the time or desire to deal with the registration process, he can use the services of professional registrars. If specialists are involved in opening an individual entrepreneur, the cost of their services will range from 3,000 to 7,000 rubles. It all depends on what specific services they will provide: only advisory or “turnkey”. Registration of a turnkey individual entrepreneur is more expensive and, on average, its price ranges from 4,000 rubles excluding state fees.

All of the above expenses can be attributed to registration, that is, to those that the future entrepreneur incurs when registering.

Having considered what is needed to open an individual entrepreneur in 2021, we will reflect these costs in the form of a table.

Payment details

If for some reason you cannot use the “Payment of state duty” service on the website of the Federal Tax Service of the Russian Federation, you can try to fill out a receipt for paying the state duty manually.

On the same website of the Federal Tax Service of the Russian Federation there is a service “Determining the details of the Federal Tax Service, the state registration body of legal entities and/or individual entrepreneurs serving a given address.”

With its help, you can determine the name, INN, KPP, OKTMO inspection, which must be indicated on the receipt as the recipient of the state duty, and the recipient’s bank details.

You will also need KBK (budget classification code), you need to indicate one of the options:

  • 18210807010011000110 (state fee for registering an individual as an individual entrepreneur when applying to the inspectorate of the Federal Tax Service of the Russian Federation);
  • 18210807010018000110 (state fee for registering an individual as an individual entrepreneur when applying through multifunctional centers).

You must indicate the payment amount - 800 rubles.

Indicate the purpose of the payment “state duty for state registration of an individual as an individual entrepreneur” and the payer’s details – full name, tax identification number, address.

An individual can check (or find out) his TIN using the “Find out your TIN” service.

Finally, the details for paying the state fee for registering an individual entrepreneur can be found out (clarified) at the tax office at the place of residence of the registered individual entrepreneur (usually such information is located in inspection offices at special stands).

What documents are needed to open an individual entrepreneur?

To open an individual entrepreneur, a citizen provides:

  1. Statement of the established form. The entrepreneur's signature is notarized (not required for personal transfer of documents).
  2. Document confirming identity, citizenship, permanent place of residence (original, copy). In addition to notarization, you will need a copy of two double-page spreads of your passport (not necessary for personal transfer of documents). The first page confirms citizenship, and the second page confirms the place of permanent registration.
  3. Photocopy of TIN;
  4. A document confirming payment of the state duty.
  5. Application for work under the simplified tax system (if necessary).

Benefits when paying the state fee for registering an individual entrepreneur

Unfortunately, there are no benefits for paying the state fee for state registration of individual entrepreneurs. Many types of taxes and fees can be paid through the State Services website with a 30% discount, but not for registering an individual entrepreneur.

However, the fee is small, and a citizen opening a business must have start-up capital. Therefore, paying the duty will probably not hurt the future entrepreneur’s pocket.

Step-by-step instructions and features of registering an individual entrepreneur in the MFC

Registration of an individual entrepreneur through the MFC begins with making an appointment with a specialist. This can be done in 3 ways:

  1. take a coupon at the MFC itself;
  2. make an appointment by phone;
  3. Log in to the “My Documents” website and fill out the online form.

The last method is very convenient for those who have an identified profile on the government services website. In this case, you will not need to additionally register with MFC services. You will be logged in automatically. If a person is unable to sign up in advance, he will be accepted on a first-come, first-served basis.

It is better to fill out an application for registration of an individual entrepreneur before visiting the multifunctional center. It states:

  • FULL NAME;
  • TIN;
  • floor;
  • passport details;
  • registration address;
  • codes of the planned activity (it is advisable to indicate the maximum number of types of business activities).

The application should be filled out electronically or handwritten, in clear handwriting (preferably in block letters) without erasures or corrections. The presence of blots and errors may cause a refusal to register an individual entrepreneur with the tax office. .

The choice of activity codes must be taken seriously. Individual entrepreneurs cannot engage in some types of activities, so the Federal Tax Service will refuse registration. The procedure may also be denied if the type of activity requires a license (for example, for taxi drivers) or mandatory notification of Rospotrebnadzor about the start of its work. The absence of such notification and license may lead to a fine or refusal to register an individual entrepreneur with the Federal Tax Service.

It is impossible to open an individual entrepreneur in the MFC by submitting documents via registered mail or courier service, as well as using an electronic signature. In this case, the applicant sends the papers directly to the Federal Tax Service.

Submitting documents to an MFC employee takes little time. According to the law, the multifunctional center cannot refuse to accept documents. This is regulated by letter of the Federal Tax Service of Russia dated February 20, 2014 N SA-4-14/3111. Only the tax office can refuse to register an individual entrepreneur.

An employee of the multifunctional center checks the complete set of documents and takes them for registration. At the same time, he issues a receipt for receipt of the papers. This receipt has a special number by which you can track your application in the future.

There is no need to contact the tax office separately if a person does not plan to use special tax regimes. If an entrepreneur switches to preferential taxation, he applies to the Federal Tax Service.
